Acceptance of Terms
By accessing elitehts.com or purchasing any product from Elite HTS Inc. ("Elite HTS," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, please discontinue use of this website and do not place an order.
These Terms apply to all visitors, customers, trade professionals, and commercial buyers. Custom order engagements and trade program relationships may be subject to additional terms outlined in a separate written agreement, which governs in the event of any conflict.
Products & Services
Elite HTS designs and manufactures premium home theater seating handcrafted in Canada. Our product lines include individual power recliners, sectional configurations, curved seating, and custom upholstered seating including the Silk Leather Collection and the Cuddle Couch Series.
- Product Descriptions — We make every effort to accurately represent materials, dimensions, finishes, and features. Colours and textures may appear differently on-screen due to monitor calibration and photographic lighting conditions.
- Custom Orders — Most Elite HTS products are built-to-order with custom fabric, configuration, and finish selections. Custom orders are non-cancellable once production has been confirmed in writing.
- Availability — We reserve the right to discontinue, modify, or substitute products without prior notice. In the event a confirmed order cannot be fulfilled as specified, we will notify you promptly and offer a comparable alternative or full refund.
- Trade & Commercial Sales — Purchases through the Elite HTS Trade Program are subject to separate trade pricing agreements and minimum order policies. Trade pricing is available to approved interior designers, AV integrators, and qualified trade professionals.
Orders & Payment
All orders placed through elitehts.com or via authorized Elite HTS sales representatives constitute a binding purchase agreement upon written confirmation from Elite HTS.
- Deposit — Custom and built-to-order products require a deposit at the time of order confirmation. Deposit amounts are specified at checkout or in your written quote.
- Balance Due — The remaining balance is due prior to or at the time of delivery, unless otherwise agreed in writing.
- Accepted Payment — We accept major credit cards, bank transfer (EFT), and financing where available. All prices are quoted in Canadian Dollars (CAD) unless otherwise stated.
- Taxes & Duties — Applicable provincial and federal taxes are calculated based on the delivery destination and are the responsibility of the buyer. For U.S. orders, Elite HTS absorbs a portion of applicable tariffs on eligible product categories as part of our cross-border project planning.
- Order Changes — Changes to in-production orders may be accommodated depending on production stage and may incur additional charges. Please contact us promptly if a change is required.
For commercial or large-volume orders, speak with our sales team directly for custom pricing and scheduling arrangements.
Shipping & Delivery
Elite HTS ships within Canada, to the United States, and to select international destinations. Delivery timelines for custom and built-to-order products are estimated at the time of order and may vary based on production scheduling and carrier conditions.
- White Glove Delivery — Most Elite HTS products are delivered via white glove service, which includes in-home placement and basic setup. Delivery details will be confirmed with your order.
- Lead Times — Due to the handcrafted, made-to-order nature of our seating, lead times typically range from 16–20 weeks from order confirmation. Timelines may vary by season and production volume.
- Delivery Address — It is the customer's responsibility to ensure the delivery address is accurate and accessible for large furniture delivery. Elite HTS is not responsible for delays or failed deliveries resulting from address errors or site access issues.
- Inspection on Delivery — We strongly recommend inspecting all items at the time of delivery. Any visible damage should be noted with the delivery team and reported to Elite HTS within 48 hours of receipt with photographic documentation.
- Risk of Loss — Title and risk of loss transfer to the buyer upon delivery to the confirmed delivery address.
Returns & Exchanges
Due to the bespoke and built-to-order nature of most Elite HTS products, we are unable to accept returns or exchanges on custom orders once production has commenced.
- In-Stock Items — Unused, unassembled in-stock items in original packaging may be returned within 14 days of delivery. A restocking fee of up to 20% may apply. Return shipping is the responsibility of the customer.
- Defective or Damaged Goods — If your product arrives damaged or with a manufacturing defect, please contact us within 48 hours of delivery with photographic documentation. We will arrange repair, replacement, or refund at our discretion.
- Cancelled Custom Orders — Deposits on custom orders are non-refundable once production has been confirmed. If Elite HTS is unable to fulfill a confirmed custom order, a full refund of all amounts paid will be issued.
Warranty
Elite HTS stands behind the quality of every product we manufacture. All Elite HTS seating is covered by the following limited warranty from the original date of delivery to the original purchaser.
- Structural Frame — Covered against structural failure and defects in materials under normal residential use for twenty (20) years, reflecting our Diamond Elite Certification standard.
- Fabric & Foam — Covered against manufacturing defects, premature wear, and delamination under normal residential use for five (5) years.
- Reclining Mechanism — Covered against mechanical failure under normal residential use for five (5) years.
- Electrical & Power Components — Covered against defects in materials and workmanship for two (2) years.
This warranty does not cover damage resulting from misuse, unauthorized modifications, accidents, pet damage, improper cleaning, or commercial use under a residential warranty. Warranty claims must be submitted in writing to our customer support team with proof of purchase and documentation of the defect.
Every Elite HTS chair passes our Diamond Elite Certification — a rigorous 10-point quality control process before it leaves our Vancouver facility.
Intellectual Property
All content on elitehts.com — including product photography, copy, design, configurator tools, brand assets, video, and proprietary materials — is the exclusive property of Elite HTS Inc. and is protected under Canadian and international intellectual property law.
You may not reproduce, redistribute, modify, or create derivative works from any Elite HTS content without prior written consent. Product photography may not be used without written authorization from Elite HTS. All trademarks, trade names, and logos displayed are the property of Elite HTS Inc. or their respective owners.
Privacy
Elite HTS is committed to protecting your personal information. Our collection, use, and storage of personal data is governed by our Privacy Policy, incorporated into these Terms by reference and available at elitehts.com/privacy-policy.
By placing an order or creating an account, you consent to the collection and use of your information as described in our Privacy Policy, including contact details required to process and fulfill your order, communicate warranty support, and provide relevant product updates.
Limitation of Liability
To the fullest extent permitted by applicable law, Elite HTS Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the purchase or use of our products or this website.
Our total liability to you for any claim arising out of or related to a product purchase shall not exceed the original purchase price paid by you for the specific product giving rise to the claim.
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable Canadian law.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
Any dispute arising from these Terms or your use of our products or website shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts of British Columbia, Canada.
Elite HTS reserves the right to modify these Terms of Service at any time. Updates will be posted to this page with a revised effective date. Continued use of our website or products following any changes constitutes acceptance of the updated Terms.
